Your Account and Registration Obligations

(e) harasses or advocates harassment of another person;


(f) involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";


(g) promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;


(h) infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];


(i) promotes an illegal or unauthorized copy of another person's copyrighted work (see "Copyright complaint" below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;


(j) Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);


(k) Provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;


(l) Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;


(m) contains video, photographs, or images of another person (with a minor or an adult).


(n) tries to gain unauthorized access or exceeds the scope of authorized access to the Website or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

(x) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancel bots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;


(y) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.


(z) shall not be false, inaccurate or misleading;


(aa) shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.


(ab) shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers;


 


2. You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content..


 


3. You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any server, computer, network, or to any of the services offered on or through the Website, by hacking, password "mining" or any other illegitimate means.

8. You may not use the Website or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of aajjo.


 


9. From time to time, you shall be responsible for providing information relating to the products or services proposed to be sold by you. In this connection, you undertake that all such information shall be accurate in all respects. You shall not exaggerate or over emphasize the attributes of such products or services so as to mislead other Users in any manner.


 


10. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Website, including payment and delivery of related products or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such advertiser.


 


11. aajjo shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).

This Website, all the materials and products (including but not limited to software) and services, included on or otherwise made available to You through this site are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, aajjo does not warrant that:

aajjo will not be liable to you in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Website. aajjo does not warrant that this site; information, Content, materials, product (including software) or services included on or otherwise made available to You through the Website; their servers; or electronic communication sent from Us are free of viruses or other harmful components.


Nothing on Website constitutes, or is meant to constitute, advice of any kind. All the Products sold on Website are governed by different state laws and if Seller is unable to deliver such Products due to implications of different state laws, Seller will return or will give credit for the amount (if any) received in advance by Seller from the sale of such Product that could not be delivered to You.


You will be required to enter a valid phone number while placing an order on the Website. By registering your phone number with us, you consent to be contacted by Us via phone calls and/or SMS notifications, in case of any order or shipment or delivery related updates. We will not use your personal information to initiate any promotional phone calls or SMS.

Payment


While availing any of the payment method/s available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

All payments made against the purchases/services on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.


Before shipping / delivering your order to you, Seller may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users.

POLICIES


Profanity Policy


aajjo prohibits the use of language that is racist, hateful, sexual or obscene in nature in a public area.


This policy extends to text within listings, on Seller pages and all other areas of the site that another User may view. If the profane words are part of a title for the item being sold, we allow Sellers to 'blur' out the bulk of the offending word with asterisks (i.e., s*** or f***).


Please report any violations of this policy to the correct area for review:


Report offensive Display Names


Report offensive language in a listing or otherwise


If a feedback comment; or any communication made between Users on the Website; or email communication between Users in relation to transactions conducted on Website contain profanity, please review Our feedback removal policy and submit a request for action/removal.


Disciplinary action may result in the indefinite suspension of a User's account, temporary suspension, or a formal warning.


Aajjo.com will consider the circumstances of an alleged policy violation and the user's trading records before taking action.


Violations of this policy may result in a range of actions, including:


Limits placed on account privileges;


Loss of special status;


Account suspension.


 


Disputes (Resolutions) Policy


Overview


Generally, transactions are conducted smoothly on aajjo. However there may be some cases where both the Buyers and Sellers may face issues. At aajjo, we have a Dispute Resolution process in order to resolve disputes between Buyers and Sellers.


What is a 'dispute'?


A 'Dispute' can be defined as a disagreement between a Buyer and a Seller in connection with a transaction on the Website.


How does a 'dispute' occur in the Marketplace?


Disputes are filed as a result of a disagreement between the Buyer and the Seller. Disputes arise out of an issue that is raised by either party not being completely satisfied with the resolution of their complaint/issue.


It is important that before a Buyer/Seller raises a dispute, they should attempt to solve the issue. Please note that whenever a Buyer raises a dispute, the Seller's payment for that order is put on hold immediately until the issue is resolved.


What are the various types of 'disputes'?


Following are the indicative examples of potential disputes:

In case the Seller rejects the return request of the Buyer, and Buyer raises a dispute, then aajjo will try to mediate and resolve the dispute between both the parties. If the dispute is resolved in favour of the Buyer, a refund is provided once the product is returned to the Seller. If the dispute is settled in favour of the Seller, Buyer is entitled to any refund.


 


Buyer Protection Program


In case of a dispute where the Seller is unable to provide a refund or a replacement, aajjo will actively work towards reaching a resolution.


The Buyer Protection Program covers Buyers who are unable to successfully resolve their dispute with the Seller or are not satisfied the resolution provided by the Seller.


In due course of resolution, aajjo’s Customer Support Team will facilitate a conference call including the Seller and the Buyer.


When a dispute has been raised, aajjo may provide both the parties’ access to each other’s Display Names, contact details including email addresses and other details pertaining to the dispute. Buyers and Sellers are subject to final consent from aajjo for settling the dispute.


Buyer Eligibility and Restrictions


• Only the Buyers who have purchased the product on aajjo are eligible for the Buyer Protection Program.


• Buyers can file a dispute within 45 days from the date of delivery of the product


• Any damage or loss to the product after delivery will not be covered under this program and will completely be the Buyer's responsibility. Buyers should refuse to accept delivery if the item is damaged.


• To be able to take advantage of the Buyer Protection Program, Buyers should first contact the Seller and attempt to resolve the issue.


• Fraudulent charges and claims are not covered under Buyer Protection Program


• If the Buyer has already initiated chargeback through the credit card issuingbank, it will not be covered under Buyer Protection Program, though in such cases a Seller can file a claim through the Seller Protection Program.


• Blacklisted and Blocked Buyers are not covered by the Buyer Protection Program.


• Through the Buyer Protection program, aajjo does not provide any guarantee/warranty to Buyers for products sold on aajjo against technical/manufacturing defects.


• Raising disputes against Sellers does not automatically entitle the Buyer to a refund or replacement for the product purchased. aajjo shall verify the disputes so raised and may process only such claims that are valid and genuine.


• aajjo shall at no point be responsible for any direct or indirect losses, expenses, costs of any nature whatsoever that may be incurred by any Buyer/Seller.


• Claims of the nature of 'Buyer remorse' (i.e. instances where products are bought by the Buyer by mistake or where the Buyer chooses to change his/her mind with regard to the product purchased by him) will not be entertained through this program.


• aajjo reserves its right to initiate civil and/or criminal proceedings against a User who, files an invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, aajjo may at its sole discretion suspend, block, restrict, cancel the Display Name [and its related Display Names] of such User and/or disqualify that user and any related users from availing protection through this program.


• Decisions made by aajjo under the Buyer Protection Program shall be final and binding on its Users.


• aajjo reserves the right to modify / discontinue Buyer Protection Program without any prior notice period to its Users.


• Through this program, aajjo shall not entertain claims of Buyers who have incurred loss due to delayed shipment or delivery of the item by the Seller.


• aajjo Customer Support Team may seek additional information / clarification from Buyer to facilitate resolution of the dispute. In the event Buyer does not respond with information / clarification sought within 10 days of such request, the dispute shall be auto-closed in favour of the Seller.


  1. Third Party Content, Sites and Services

    1. The Site and content available through the Service may contain features and functionalities that may link or provide the User with access to third party content which is completely independent of the Site, including web sites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole

    2. User's interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the User and such organizations and/or individuals. The User should make whatever investigation necessary or appropriate before proceeding with any On-line transaction with any of these third parties.

    3. The User agrees that the Company shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this Site, or between Users and any third party, the User understands and agrees that the Company is under no obligation to become involved. In the event that the User has a dispute with one or more other Users, the User hereby releases the Company, its Directors, officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or the Service(s).

    4. Company has established relationships with third parties to offer User the benefit of other products and services which the Company does not offer. The Company offers User access to the third parties website(s) either through the use of hyperlinks to their sites from the Site, or by offering “co-branded” or third party websites in which both the Company and these other/third parties share the same uniform resource locator, domain name or pages within a domain name on the Internet. In some cases, User may be required to submit information for purposes of registering or applying for products or services provided by such third parties or co-branded partners. The User terms and privacy policy of such third parties may differ from ours, and the Company does not have any control over the information that a User may choose to submit to such third parties or co-branded sites. Company therefore encourages all User(s) to read the third-party usage terms and conditions and privacy and other policies policy before responding to any offers, products or services provided by such other parties and/or using their Website(s). Company does not endorse or otherwise accept responsibility for the content or privacy or other policy of such co-branded third-party Site.

  2. Relationship of the Parties

    1. It is clarified that there is no agency or/and partnership or/and joint venture or/and employee-employer or/and franchiser-franchisee relationship between the Company and any User.

  3. Suspension, Reinstatement and Refunds

    1. Without prejudice to any other rights or remedies that may be available to it, the Company may suspend all services provided, remove and/or disable any and all User Hosted data and content and/or limit access rights of a User for a breach or violation as is set forth herein.

    2. User hereby authorises Company to remove and/or disable User hosted data and/or content or to limit Services to a User against whom a complaint is received, which remain unresolved or is not amicably settled with thirty (30) days of the date of the complaint by the aggrieved User.

    3. When the Service subscribed for is suspended without remedy for more than 45 (forty-five) days, the Company shall have the option to terminate the membership of the User and the consequences set forth in Clause 22 shall follow.

    4. The Company may at its discretion and subject to such terms as it deems proper, reinstate a User and/or User Hosted data and re-start a Service

    5. A User dissatisfied with a Service may request Company for a refund provided the request is made in writing and addressed to the Grievance Officer in terms of Clause 24. The company reserves its decision to accept or decline the request for refund

  4. Termination of Agreement

    1. The User hereby agrees that Company, in its sole discretion, has the right (but not the obligation) to delete or deactivate a User account, block its email or IP address from the Site, or otherwise terminate its access to or use of the Service (or any part thereof) and/or the Site immediately and without notice, and remove any content Hosted within the Service/Site, for any reason, including, without limitation, if Company believes that the User has acted inconsistently with this Agreement. Further, the User agrees that Company shall not be liable whether for refunds or otherwise, to the User or any third-party for any termination of the Users access to the Service. The User agrees that it shall not attempt to use the Service after the Date of Termination.

    2. If the Company terminates User(s) membership, User(s) will not have the right to re-enroll or join Site under a new account or name or an alias unless formally invited to do so by the Company. Notwithstanding any contained herein, no membership charges will be refunded to a User in case of termination.

  5. Liabilities upon Termination

    1. Without prejudice to any rights or remedies available to the Company, the User shall upon termination of the Agreement be liable for payment of any balance fees or charges payable until the Date of Termination.

    2. The amounts due and payable to the Company by the User upon termination shall be payable within 30 (thirty) days of the Date of Termination.

  6. Grievance Redressal

    1. For any complaints and grievances, User may contact the Grievance Officer, Aajjo.com, I-24, Sector -1, Bawana Industrial Area, New Delhi – 110 039 India. +91-12- 04418308; or email: support@aajjo.com

    2. All complaints to the Grievance Officer shall be made in writing giving a detailed description of the complaint/grievance of the User.

    3. The Grievance Officer shall redress all complaints within one (1) month from the date of receipt of complaint.

  7. Arbitration Clause for Dispute

    1. Any dispute or difference of any nature whatsoever arising out of or in relation to this Agreement including in respect of the indemnity clause of this Agreement shall be finally decided by a Sole Arbitrator to be nominated by the Director of the Company (hereinafter referred as "the nominating authority"). The Sole Arbitrator so appointed by the nominating authority shall be a practicing Advocate of not less than 5 years in practice or a retired judge of the High Court. The User shall not be entitled to raise any objection to any such Sole Arbitrator appointed by the nominating authority on any ground whatsoever. The arbitration shall be held in accordance with the provisions of the Arbitration & Conciliation Act, 1996 or any other applicable law at the relevant point of time. The language of the arbitration shall be English and the award rendered in arbitration shall be a reasoned award in writing and shall be conclusive and binding on the parties. The venue of arbitration shall be at New Delhi, India.

  8. Partnership or Agency:

    1. None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and Aajjo.com and you shall have no authority to bind Aajjo.com in any form or manner, whatsoever..

  9. Linking and Framing:

    1. You may not frame the Services. You may link to the Services, provided that you acknowledge and agree that you will not link the Services to any website containing any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topic, name, material, or information or that violates any intellectual property, proprietary, privacy, or publicity rights. Any violation of this provision may, in our sole discretion, result in termination of your use of and access to the Services effective immediately.

  10. Governing Law and Jurisdiction

    1. This Agreement and any dispute or matter arising out of or in connection with and/or incidental to the use of the Site and/or the Services shall be governed by the laws of India without regard to its conflict of law’s provisions.

    2. The User and the Company hereby irrevocably submit to the sole and exclusive jurisdiction of the courts at Delhi, India.

  11. Fraud Warning

    1. Keep your personal details secret. Never write down or disclose your account details, and passwords with anyone. Keep your credit card and ATM cards safe.

    2. All Users are advised to be very careful while doing business with individuals, body corporates or companies from any part of the world.

    3. Users are advised to exercise due caution while transacting with a prospective buyer or a seller on the Site. Users must undertake interactions or transactions with organizations and/or individuals located on or through the Site, with reasonable caution and after undertaking thorough diligence on such organization and/or individual. Neither the Company nor its director’s, employees, officers or agents shall be liable to any User or otherwise for any illegal or fraudulent interaction or transaction with organizations and/or individuals located on or through the Site.

    4. Users are advised to not send any advance money/legal fee or products unless there is cash in your account or an irrevocable letter of credit from the buyer, duly authorised by the buyer’s bank.

    5. Users are advised not to transact business unless full payment is made to you before shipping of the products.

    6. CREDIT CARD SCAMS - When a User receives any online Order paid by Credit Card, it is recommended that you ask for a written Credit Card Authorisation to be faxed to you. Please get validity of the Credit Card checked with your Bank or contact VISA, Master Card or American Express directly. Unless the validity of the Credit Card is confirmed, please do not ship any goods.

    7. BANK DRAFT SCAMS - BANK DRAFT SCAMS - There have been cases of people receiving Bank Drafts with unauthorised printing of Bank Names. Before shipping any product or advancing a partial cash advance, you must wait for the Bank to clear the Bank Draft/Check.

    8. Registration/License/Tender Fee SCAMS - Cases have been reported where an offer is sent to buy a large number of goods after the seller pays them a Registration/License/Tender Fee. They post Offers to BUY large quantity of Computers and other material. Once you submit your bid; you will be notified that your Tender has been accepted.
